1.1 Validity. These terms and conditions apply to purchase and sale contracts for goods ordered from the online store of Artonella OÜ (hereinafter the Seller) www.uneleja-kingipood.ee. The conditions are valid until 31.12.2023.

1.2 Entry into force of the agreement. The purchase and sale agreement between the parties based on the order is deemed to be concluded with the consent of the Seller regarding the ordered goods. The seller is deemed to have accepted the order from the moment he sends the order confirmation to the buyer, but at the latest when the ordered goods are handed over to the customer.

1.3 Order fulfillment deadline. If the buyer has chosen “advance payment to current account” as the payment method, the Seller will start fulfilling the order after receiving the payment to the current account. The seller fulfills the order within eight working days after receiving the payment. If the order fulfillment deadlines for some goods are longer, the order fulfillment deadline is added to the product description. If the Buyer has specified “ransom payment” as the payment condition, the Seller starts fulfilling the order immediately, and the Buyer receives the goods against the ransom payment within eight working days after the order. In case of courier service, the Goods will be delivered to the Purchaser by Itella Smartpost or DPD courier. The buyer will receive a notification via SMS or e-mail about the arrival of the goods and, in the case of a ransom payment, also about the amount that the buyer must pay in cash for the goods when the courier arrives. On the day of the goods’ arrival, the courier contacts the Buyer by phone to specify the time of delivery of the goods. If the courier cannot get in touch with the buyer, a corresponding message is left in the buyer’s mailbox and he is asked to contact the courier company.

If the Buyer has indicated “Smartpost” as the delivery method, the Seller delivers the goods to the Itella Smartpost parcel machine selected by the Buyer. If the Buyer has indicated “DPD” as the delivery method, the Seller delivers the goods to the DPD parcel machine selected by the Buyer.

1.4 Payment method and price. The prices in the e-shop are in euros and include VAT.

For the Estonian customer, the following shipping cost is added to the price of the goods:

– 3.60 EUR when delivering goods to a Smartpost or DPD parcel machine

– 6.00 EUR when delivering the goods to the customer’s home by courier

– 0.00 EUR if the customer comes to the Uneleja gift shop in Tabasalu Center to pick up the goods.

When shipping to Finland, Sweden, Denmark, Latvia or Lithuania the following cost is added to the price of the goods:

– 13.00 EUR when delivering goods to a parcel machine

– 18.00 EUR when delivering the goods to the customer’s home by courier

The transport fee will be noted on the invoice.

1.5 Delivery of goods. The seller is obliged to deliver the ordered goods in the territory of the Republic of Estonia and the Republic of Finland. In the event that the ordered goods cannot be sent out of the warehouse immediately, the Seller will send the ordered goods to the Buyer in several shipments. In this case, the shipping fee must be paid only for the delivery of the first shipment.

1.6 Cancellation of order. The buyer has the right to withdraw from the purchase and sale agreement concluded on the basis of the order without reason within 14 days from the delivery of the goods to the buyer. To withdraw from the contract, the Buyer must make a corresponding written statement to the Seller via e-mail and then return the ordered goods to the Seller. When withdrawing from the contract, the Seller returns the cost of the goods to the Buyer. The seller does not return the courier fee of the ordered goods to the buyer. The goods to be returned must not be used and the goods must be in the unopened original packaging. If the goods to be returned have deteriorated, the Buyer must compensate for the decrease in the value of the item.

1.7 The seller’s right to withdraw from the contract. The Seller has the right to withdraw from the purchase and sale agreement concluded on the basis of the order, if the Seller’s stock of the corresponding goods has been exhausted. The same also applies if the order has been submitted by a person who does not have the right to do so according to this agreement.

1.8 Refund in case of withdrawal from the contract. In case of withdrawal from the contract, the Seller will return the price paid for the goods to the bank account specified by the Buyer within 14 days at the latest. If the buyer withdraws from the contract and returns the goods, the return does not include the postal or courier service and the redemption fee.

1.9 Warranty conditions. The seller provides a warranty provided by law for the ordered goods. The warranty is only valid with the purchase invoice or order confirmation. In the event of a defect, the Buyer has the right to demand that the Seller exchange the goods. If it is not possible to exchange the goods, the buyer has the right to cancel the order. The warranty does not apply if the lack of goods is due to improper and incorrect use of the goods or normal wear and tear.

1.10 Ownership. Until full payment for the goods is made, the goods are the property of the Seller.

1.11 Pledge of Claims. The Seller has the right to assign and pledge the claims arising from the purchase and sale agreement concluded with the Buyer to third parties. The Seller has the right to demand from the Buyer, in the event of a delay in the Buyer’s payments, also the costs associated with the collection of claims arising from the purchase and sale agreement concluded with the Buyer, including costs for legal assistance and debt collection services.

1.12 Limitation of liability The Seller is liable for the violation of the purchase and sale agreement concluded on the basis of the order, as well as for the damage resulting from the nature of the goods delivered to the Buyer by the Seller or caused to the Buyer by their use, only if the damage was caused by the Seller’s intent or gross negligence.

PRIVACY POLICY

  1. Personal data and their use

1.1. The user gives clear and informed consent to the store manager (Artonella OÜ, reg. code 12583389, reg. address Rannamõisa tee 38d, 13516 Tallinn, Republic of Estonia) to process his personal data.

1.2. When placing an order, the personal data entered by the user and made known to the provider will be entered into the customer register and used to provide sales services and offer goods to the Customer.

1.3. The source of personal data is the creation of a customer relationship when registering an order in the e-shop.

1.4. The registered personal data includes information about the Customer’s order (surname, first name, street, house, apartment number, settlement or city, zip code, phone number, year of birth, gender, delivery method, used payment method).

1.5. Personal data, which are necessary for the delivery of goods to the Customer, may be forwarded to companies providing courier services.

1.6. The store manager undertakes not to pass on registered personal data to third parties.

1.7. The store administrator reserves the right to transfer user data if they are transferred to a person who processes the data to fulfill a legal obligation and has the legal right to do so.

1.8. The client has the right to check his personal data, as well as to change them or remove them from the register.

1.9. The user gives consent to the e-store manager to send order confirmation to the e-mail address entered when placing the order.

1.10. The user gives consent to the e-store administrator to send sales offers to the e-mail address entered when placing the order, if he has marked the corresponding consent with a check mark on the order submission page in the corresponding window.
